No:9/2, 59930 Ergene / Tekirdağ, Turkey. These Terms & Conditions ("Terms") govern your use of this Site and any order you place with us.
We supply medical packs, kits, apparel, and related products primarily to hospitals, clinics, distributors, and other healthcare professionals and businesses ("Business Customers"). Where a purchase is made by a natural person acting for purposes wholly or mainly outside that person's trade, business, craft or profession ("Consumer"), the additional consumer-protection provisions in Sections 7 and 8 of these Terms apply, in accordance with EU Directive 2011/83/EU on consumer rights. Business Customers are not covered by those consumer-specific provisions; their orders are governed by the commercial terms agreed with us.
Product listings on the Site are an invitation to order, not a binding offer by us. Placing an order constitutes an offer by you to purchase; a contract is formed only when we confirm acceptance of your order (for example, by email or order confirmation). We may decline or cancel an order, including where a product is unavailable, priced incorrectly, or where we reasonably suspect misuse, and will inform you promptly if this occurs.
Prices are displayed in the currency shown at checkout. Where applicable, prices indicate whether VAT is included or, for eligible intra-EU business customers with a valid VAT identification number, whether the reverse-charge mechanism applies. Please confirm the correct VAT treatment for your order at checkout or by contacting us. We reserve the right to correct pricing errors before a contract is formed.
Payment terms are set out on our Payment Policy page. Business Customers with an approved account may be offered invoice-based payment terms as separately agreed.
Delivery times shown on the Site are estimates and not guaranteed. Risk in the products passes to you on delivery; for Consumers, this is when you or a person you nominate takes physical possession of the goods, in line with Article 20 of Directive 2011/83/EU.
This section applies only to purchases made by Consumers, as defined in Section 2.
Under the EU Consumer Rights Directive (2011/83/EU), you have the right to withdraw from your purchase within 14 calendar days of receiving the goods, without giving any reason, by notifying us clearly (for example, via our Contact page or by post to our Sofia address).
Full details of the withdrawal process, refund timing, and return shipping are set out in our Return Policy, including important exceptions for sealed, sterile, or hygiene-sensitive medical products, which cannot be returned once unsealed after delivery, in accordance with Article 16(e) of Directive 2011/83/EU.
For Consumers, we are legally required to supply goods that conform to the contract, in line with Directive (EU) 2019/771 on the sale of goods. If a product is faulty or not as described, please contact us and we will remedy this by repair, replacement, price reduction, or refund as appropriate and as required by applicable law. For Business Customers, warranty terms are as separately agreed or, in their absence, as required by applicable Bulgarian commercial law.
We take care to ensure product descriptions, certifications, and regulatory markings (such as CE marking, where applicable) are accurate. Medical devices supplied through this Site are intended for use by qualified healthcare professionals in accordance with their intended purpose and any accompanying instructions for use. Nothing on this Site constitutes medical advice.
All content on this Site, including text, graphics, logos, and product images, is owned by or licensed to SUBMED and protected by intellectual property laws. You may not reproduce or reuse this content without our prior written consent.
To the maximum extent permitted by applicable law, SUBMED shall not be liable for indirect, incidental, or consequential losses arising from your use of the Site or products purchased through it. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or defective products under Directive 85/374/EEC on product liability.
These Terms are governed by the laws of Bulgaria and applicable European Union law, without prejudice to any mandatory consumer-protection provisions of the country in which a Consumer is habitually resident. Consumers may bring proceedings in the courts of Bulgaria or their own country of residence, as applicable under EU rules on jurisdiction.
The European Commission's online dispute resolution (ODR) platform is no longer operational. Consumers in the EU may instead use the out-of-court dispute resolution bodies available in their own member state.
We may update these Terms from time to time. Changes will apply to orders placed after the updated Terms are published on this page.
